Some types of businesses may need licences, permits or registrations to operate and sell good or provide services. Some licences for nightclubs are obvious but for example a business which sells food between the hours of 11pm and 5am need a late hours catering licence.
To create a great atmosphere in my coffee shop I want to play music for my customers however, it is not as simple as many people think because if I have the radio on and play music, I am breaking the law as I do not have their license to do so in public. To make sure I do not break the law I will have to pay the performing rights to the "Performing Rights Society.
Legal responsibilities
Careful attention needs to be paid to businesses’ staff and their rights. There are many laws affecting health and safety at work, paying and equal opportunities.
Health and safety
Stringent rules are set out to ensure that businesses do all they can to protect their workers. The main legislation in Britain is the Health and safety at Work Act. This sets the minimum standards which employers must maintain the working environment and workplace. This includes:
• Businesses must provide all necessary safety equipment and clothing
• Making sure that workers have regular brakes
• Employers must provide a safe working environment
• All businesses must have a written safety policy on display
• All businesses must keep temperatures comfortable
I must make sure that my own business meets all legal requirements, specifically health and safety regulations and food hygiene legislation. I also need to provide adequate washrooms and toilet facilities and create a hygienic and safe environment for my workers to work in.
Contract of employment
Anyone employed in the business within two months of starting work must received a contract of employment that clearly sets out their conditions and service such as duties, hours of work, job title and description, holiday pay, sick pay agreement, the amount of pay and how often payments will be made etc. Each contract of employment must include the name of the employer and employee and clearly shows all duties and responsibilities.
Thinking about my own business, I must guarantee a contract of employment for each employee within two months should have a contract of employment that clearly sets out all conditions, duties and responsibilities. According to HM Revenue & Customs each employee within my business must be paid at least:
- £5.73 per hour for workers aged 22 years and older
- £4.77 per hour for workers aged 18-21
- £3.53 per hour for all workers under the age of 18
Discrimination
Equal Pay Act 1970 – This Act states that I must treat both sexes equally. A woman employed in the same job as a man must have the same pay and conditions.
Disability Discrimination Act 1995 –This Act states that it is unlawful for an employer to discriminate against a disabled person by refusing to provide adequate services.
The Race Relations Act 1976 states that it is unlawful for an employer to treat or fail to prevent the treatment of workers less favourably because of their colour, race, nationality, ethnic or national origins.
As an owner of a business ,I must make sure I meet all of these requirements listed above. I should also remember that part-time workers must also be given the same rights and contortions as full-time workers.
To meet The Disability Discrimination Act, my business must offer toilets for disabled people, menu in “Brail language” for the benefit of the blind people and each service provided by my business must be equally available for disabled people."

surely that is the job of your tutor to check spelling and correct mistakes…..after all they’re the ones who are paid to do that…not us!
and in any case most of us are not experts….so what if we tell you wrong?
